  1. THE SERVICES & AGENCY STATUS

    1. Role of the Company: The Thinking Luxury LTD (“the Company”) acts strictly as a Travel Advisor, Booking Agent, and Bespoke Facilitator. We curate, coordinate, and facilitate travel, hospitality, charters, tours, and itinerary arrangements on your behalf.

    2. Contractual Relationship: When you book a travel component or service (e.g., hotel, resort, package holiday, private charter, villa rental, guided tour, or activity), your direct legal contract for the delivery of that service is held exclusively with the third-party service provider or venue (“Supplier”).

    3. Supplier Terms: You are bound by the Supplier’s own terms and conditions (e.g., resort policies, charter agreements, cancellation rules). It is your responsibility to review these terms upon confirmation.

    4. Commercial Flight Policy: The Company does not book or issue commercial airline tickets. All commercial flights must be booked directly by the Client.

2. DEFINITION

The following terms shall have the meaning ascribed to them below:

  1. The Company / We / Us: The Thinking Luxury LTD, trading as The Thinking Luxury, acting as a Travel Design Advisory, Booking Agent, and Facilitator.

  2. The Client / You: The individual or corporate entity engaging the Company for travel design, itinerary coordination, or travel facilitation.

  3. Services: Route design, peer collaboration, itinerary planning, resort/hotel bookings, charter coordination, and travel management provided by the Company.

  4. Supplier: The independent third-party provider (e.g., hotel, resort, tour operator, charter company, ground handler, or activity operator) with whom the Client enters into a direct contract.

  5. Request: Any query or instruction submitted by the Client for travel design, individual bookings, or group travel arrangements

  6. Consultation Fee: A deductible fee applied for extensive travel research or complex multi-country itinerary design prior to booking confirmation.

  7. Package: Services as defined by the UK Package Travel and Linked Travel Arrangements Regulations 2018, which the Company does not sell.

  8. Client Default: Any act or omission by the Client, including but not limited to failure to make payment, late arrival at departure points, or failure to provide necessary travel documentation.

3. NON-PACKAGE TRAVEL & INDEPENDENT COMPONENT STRUCTURE

  1. Facilitation Status: The Thinking Luxury LTD acts strictly as an Introductory Agent and Bespoke Facilitator. We curate and facilitate independent travel components. Our services do not constitute a combined "Package" or "Linked Travel Arrangement" under the UK Package Travel and Linked Travel Arrangements Regulations 2018.

  2. Independent Component Structure: To preserve the legal status of independent components, payments for individual travel components are processed either directly with the end Supplier or by the Company acting strictly as a collection agent.

  3. No Linked Travel Arrangements (LTA): The Company does not facilitate "Linked Travel Arrangements". We do not lead the Client to purchase additional travel services from different traders in a targeted manner that would trigger LTA protections. Any additional services requested by the Client are treated as new, independent instructions.

  4. Limitation of "Organiser" Liability: By entering into this Agreement, the Client acknowledges that the Company is not responsible for the Insolvency Protection or performance of third-party Suppliers. Recourse for supplier failure rests solely against that specific Supplier’s insurance or financial protection schemes.

  5. Business Travel Exemption: Where the Client is a business entity and arrangements are requested for corporate travel, hosted groups, or corporate retreats under a general business agreement, such arrangements are expressly excluded from the scope of the 2018 Regulations under Regulation 3

4. BOOKING EXECUTION, PEER NETWORK & ITINERARY REALITIES

  1. Integrity & Service Discretion: The Company reserves the absolute right to decline any Request that conflicts with safety standards, applicable laws, or our professional ethics.

  2. Sourcing Timelines: Specified schedules and availability are provided as estimates. While we employ all professional endeavours to secure preferred arrangements, the Company is not liable for availability changes caused by external third-party variables.

  3. Collaborative Peer Network: In designing bespoke itineraries and sharing field notes, the Company collaborates with a global network of trusted local specialist peers. While these insights are curated with professional diligence, local conditions, seasonal access, and ground realities remain subject to change.

  4. Itinerary Adaptations & Pace: Recommendations regarding route timing, travel pace, and transfers are advisory. Where real-world conditions (e.g., weather or regional logistics) require adaptations, the Company will assist in facilitating modifications with Suppliers, but operational control rests with the respective Supplier.

  5. Regulatory & Safety Compliance: The Company maintains the right to modify Services to adhere to applicable laws or safety requirements.

  6. Industry Partnerships: The Client acknowledges that the Company may receive industry commissions, rebates, or incentives from Suppliers upon successful booking execution.

  7. Specialist Sub-Contracting: The Company may utilise its network of specialist third-party consultants to assist in delivering complex Requests. Such partners operate subject to the same liability limitations as the Company.

  8. Special Requests & Medical Suitability: Special requests (such as room locations, bedding configurations, or dietary preferences) are passed to Suppliers but cannot be guaranteed unless confirmed in writing by the Supplier. Clients must disclose any mobility restrictions or medical requirements prior to confirmation to ensure the chosen itinerary and pace are suitable.

  9. Independent Excursions & Local Waivers: The Company accepts no liability for ad-hoc excursions or activities booked directly by the Client while traveling. The Client acknowledges that certain specialist operators (such as safari, wilderness expedition, or marine charter suppliers) may require guests to sign local indemnity waivers prior to participation. Refusal to sign required supplier waivers does not entitle the Client to a refund.

5.SPORTS PACKAGES, EVENT ACCESS & LIFESTYLE SOURCING

  1. Charter & Property Agreements: For marine charters, aviation transfers, villa rentals, or group lodge stays, the Client will execute a direct Agreement provided by the end operator.

  2. Group & Hosted Travel: For family, multi-generational, corporate, or personally hosted/accompanied group travel, the lead Client assumes responsibility for ensuring all participating guests adhere to payment timelines, health requirements, and operator conduct rules.

  3. Property & Asset Liability: The Client assumes full financial liability for any property or asset damage caused by themselves or their party during a stay or charter.

  4. Client Conduct & Behaviour: The Client is responsible for ensuring that all members of their party conduct themselves appropriately without causing danger, distress, offense, or property damage. If in the reasonable opinion of the Company or a Supplier, a Client’s behaviour is disruptive or unsafe, arrangements may be terminated immediately without entitlement to refunds or compensation.

6. PLANNING APPROACH & CONSULTATION FEES

  1. Complimentary Travel Design Model: The Company generally operates on a fee-free basis for standard travel design, hotel reservations, packaged holidays, and travel coordination.

  2. Complex Consultation Fee: Where a Request involves lengthy research, highly complex multi-country itineraries, or specialised travel sourcing prior to booking, the Company reserves the right to charge an upfront Consultation Fee. Any such fee will be agreed upon in writing before work begins.

  3. Deductible Credit Structure: Upon confirmation and booking of the curated itinerary through the Company, 100% of the Consultation Fee will be credited directly against the final balance of your travel arrangements.

  4. Non-Refundability: If the Client decides not to proceed with the proposed itinerary after research has commenced, the Consultation Fee remains non-refundable as compensation for our strategic time, research, and peer collaboration.

7. PAYMENTS, CURRENCY & PRICE ADJUSTMENTS

  1. Payment Schedule: Supplier deposits and final balances must be paid according to deadlines set by the Supplier or Company. Payments may be made via BACS/Wire Transfer or major credit cards. Credit card processing fees may apply.

  2. Supplier Payment Terms: Specialised suppliers (such as aviation charter or yacht operators) often require 100% non-refundable payment upfront to lock asset availability.

  3. Currency & Price Adjustments: Prices are subject to adjustment prior to final payment due to exchange rate fluctuations, fuel surcharges, or vendor price updates.

8. CANCELLATIONS, AMENDMENTS, REFUNDS & LOGISTICS

  1. Contractual Finality: All travel contracts are held exclusively between the Client and the Supplier. Cancellations, amendments, or refund requests are governed strictly by the Supplier’s specific terms.

  2. Substitutions: If an asset or travel service becomes unavailable, the Company may propose a comparable alternative. If declined after Supplier payment processing, the Company will assist in requesting a refund from the Supplier.

  3. Description Accuracy: Vendor representations are approved by Suppliers. The Company acts as an informational conduit and is not liable for vendor inaccuracies.

  4. Refund Monitoring: The Company will notify the Client once Supplier refund processing is officially confirmed.

  5. Unused Services & Voluntary Alterations: No refunds, credits, or adjustments will be issued for unused accommodation, transfers, activities, or itinerary components resulting from the Client’s voluntary choice, late arrival, or early departure after travel has commenced. Any voluntary alterations made by the Client while abroad are at their own expense and risk.

  6. Complaint Procedure & Notice Window: In the event of any dissatisfaction during a journey, the Client must inform the Supplier immediately on the ground to allow an opportunity to remedy the issue. If unresolved, the Client must notify the Company in writing within 28 days of the conclusion of their travel arrangements. Failure to follow this notification procedure may affect or limit the ability to investigate and resolve the claim.

9. MANDATORY TRAVEL INSURANCE

  1. Required Coverage: Because travel arrangements involve non-refundable commitments, the Client is strongly advised to maintain comprehensive travel, medical, cancellation, and charter insurance. The Company accepts no liability for losses resulting from inadequate coverage.

10. ENTRY COMPLIANCE, HEALTH & DIGITAL AUTHORISATIONS

  1. Passports & Visas: The Client and all accompanying guests are solely responsible for possessing valid passports (minimum 6 months validity) and required visa

  3. Regulatory Documentation: Clients are responsible for securing necessary International Driving Permits (IDP) or medical proof required by local laws. The Company does not verify client documentation validity.

11. LIMITATION OF LIABILITY & PROTECTIONS

  1. Statutory Liability: Nothing in these Conditions limits or excludes liability for death or personal injury caused by proven negligence, fraud, or statutory consumer rights under English Law.

  2. Consumer Protection Clause: Where the Client acts as a consumer, exclusions in Section 11 apply only to the extent permitted by law.

  3. Exclusions of Loss: Subject to Clause 11.1, the Company shall not be liable for indirect economic loss, lost profits, or consequential damages.

  4. Supplier Independence: Suppliers are independent contractors. The Company is not liable for supplier acts, omissions, or insolvency.

  5. Financial Liability Cap: The Company's aggregate liability shall be strictly limited to the total value of any Consultation Fee received for that specific instruction.

  6. Force Majeure: The Company is not liable for performance delays caused by events beyond its reasonable control (e.g., severe weather, acts of God, strikes, global health emergencies, or government restrictions).

  7. Professional Indemnity: The Company maintains Professional Indemnity Insurance covering its advisory obligations.

12. COMMENCEMENT, DURATION, AND TERMINATION

  1. Commencement: Engagement officially commences when the Company confirms receipt and acceptance of a Client Request in writing.

  2. Conclusion & Transition: Facilitation services conclude once payment is cleared and the booking is confirmed with the Supplier, at which point operational execution transitions strictly to Supplier Terms.

  3. Termination for Breach: The Company reserves the right to terminate Services immediately if the Client fails to make payments, provides fraudulent data, or commits a Client Default.

  4. Survival: Termination shall not affect the survival of protective clauses including Section 11 (Limitation of Liability) and Section 14 (Governing Law).

13. EDITORIAL STANDARDS & PLATFORM CONTENT

  1. Platform Insights: Platform field notes reflect real-world travel expertise and collaborative input from our peer network. All views and opinions are uniquely our own and provided for informational purposes.
